An Auburn man is returning to prison after a Schuylkill County judge revoked his parole on Monday.
Brian L. Brobst, 31, will return to prison for at least two months and could remain there until March 10, 2015, Judge Jacqueline L. Russell ruled.
"You're not amenable to supervision," Russell told Brobst.
Brobst originally pleaded guilty on Oct. 17, 2012, to criminal mischief, with prosecutors withdrawing charges of burglary, theft and receiving stolen property. At that time, Russell sentenced him to 17 days to 12 months in prison, pay costs and $50 to the Criminal Justice Enhancement Account and perform 20 hours community service.
State police had charged Brobst with committing his crime on Dec. 13, 2011, in West Brunswick Township.
Brobst violated his parole by being an absconder from supervision, Russell ruled.
"I had three warrants out," Brobst told Russell.
In other recent county court action, a Pottsville man will spend time on house arrest instead of in prison after admitting Wednesday that he sold marijuana in September 2012 in the city.
David W. Viars Jr., 36, must serve six to 23 months on house arrest with electronic monitoring, Judge James P. Goodman ruled.
Goodman also sentenced Viars to pay costs, $100 to the Substance Abuse Education Fund, a $50 CJEA payment and $113 restitution to the state police crime laboratory in Bethlehem and submit a DNA sample to law enforcement authorities. He made the sentence effective at 9:30 a.m. May 7.
"You have to comply with all the conditions. You may go to state prison" if you do not, Goodman warned Viars.
Viars pleaded guilty to delivery of a controlled substance, possession with intent to deliver a controlled substance and possession of a controlled substance. Prosecutors withdrew a charge of criminal use of a communication facility.
Pottsville police charged Viars with selling $60 worth of marijuana to a confidential informant on Sept. 13, 2012.
Also in county court news, a Pottsville man will spend time on probation after admitting Monday that he committed a theft in August 2012.
William J. Vesay, 41, pleaded guilty to theft, receiving stolen property and defiant trespass.
Goodman accepted Vesay's plea and sentenced him to spend 12 months on probation and pay costs, $50 to the CJEA and a $50 bench warrant fee.
State police at Schuylkill Haven alleged Vesay committed his crimes on Aug. 20, 2012, in Porter Township.
Also on Monday, Lindsay A. Brown, 31, of Port Carbon, pleaded guilty to theft and receiving stolen property.
Goodman sentenced Brown to serve 12 months on probation, pay costs and a $50 CJEA payment and perform 10 hours community service.
Pottsville police charged Brown with committing the theft on June 5, 2013, in the city.
Goodman on Wednesday also accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Thomas E. Nesbitt, 44, of Pottsville; no contest plea to theft; 12 months probation and 10 hours community service. Prosecutors withdrew a charge of receiving stolen property.
Zachary D. Pisanchyn, 21, of MaryD; possession of drug paraphernalia and purchase, consumption, possession or transportation of an alcoholic beverage; 12 months probation.
Steven T, Rhoades, 24, of Schuylkill Haven; retail theft; two to 12 months in prison.
Zachary A. Rossi, 29, of Lansford; possession of drug paraphernalia; 30 days to 12 months in prison with immediate parole, $100 SAEF payment and $164.95 bench warrant fee.
William J. Smith, 32, of Ashland; resisting arrest; 23 months probation consecutive to current sentence and $50 CJEA payment. Prosecutors withdrew charges of disorderly conduct and public drunkenness.
William J. Strimboulis Jr., 44, of Butler; simple assault; two to 23 months in prison with immediate parole and $50 CJEA payment. Prosecutors withdrew two counts of harassment and one of disorderly conduct.
Russell Teter, 38, address not known; possession of a small amount of marijuana and possession of drug paraphernalia; 12 months probation.
Fred S. Williams, 51, of Pottsville; fleeing or eluding police; 18 months probation and $50 CJEA payment. Prosecutors withdrew charges of driving under suspension, operating vehicle without required financial responsibility, careless driving, reckless driving, driving without a license, violation of restrictions on alcoholic beverages and no rear lights.
Renee E. Gibas, 42, of New Philadelphia; two counts of retail theft; 35 months probation and 99 cents restitution.
Michael A. Keiper, 36, of Weissport; possession of a small amount of marijuana; 15 to 30 days in prison with immediate parole, $100 SAEF payment, $50 bench warrant fee and $113 restitution to the state police crime laboratory in Bethlehem.
Meagan E. McCabe, 21, of Pottsville; improper furnishing of drug-free urine; 12 months probation consecutive to current sentence.
Raven L. Negron, 23, of Mahanoy City; DUI and retail theft; time served to 18 months in prison with immediate parole, $1,000 fine, $100 SAEF payment, $460 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service.
All defendants who were sentenced must pay costs as a part of their sentences.
