ORWIGSBURG - Already serving time in Schuylkill County Prison, an Auburn man is headed back to Schuylkill County Court after waiving his right to a preliminary hearing Tuesday on charges of delivering methamphetamine in 2011.

Brian L. Brobst, 31, of 38 Rocky Road, faces charges of delivery of a controlled substance, possession with intent to deliver a controlled substance, possession of a controlled substance and criminal use of a communications facility.

Magisterial District Judge James R. Ferrier bound over the charges for court after Brobst waived his right to the hearing.

State police at Reading alleged Brobst used a cellphone to arrange the sale of, and then sold, methamphetamine between Oct. 11, 2011, and Dec. 1, 2011, in West Brunswick Township.

Police said Brobst dealt with Clayton Pepe, who is serving a federal prison sentence for drug-related crimes.

Brobst is in prison in this case in lieu of posting $5,000, 10 percent of his $50,000 percentage bail.

On April 28, county Judge Jacqueline L. Russell revoked Brobst's parole in another case involving a conviction for criminal mischief and returned him to prison until at least June 28. Brobst could remain behind bars for that crime until March 10, 2015.

Other defendants whose cases Ferrier considered on Tuesday, the charges against each one and the judge's dispositions of those matters included:

Christopher T. Czarick Sr., 30, of 18 Center Ave., Schuylkill Haven - two counts each of conspiracy and possession of a controlled substance and one each of possession with intent to deliver a controlled substance and possession of drug paraphernalia; right to preliminary hearing waived, charges bound over for court.

State police at Reading alleged Czarick possessed heroin, Suboxone and drug paraphernalia about 3:15 p.m. March 7 at his residence. Czarick is free on $10,000 unsecured bail pending further court action.

Dex A. Mahute, 23, of 229 Union St., Pottsville - accident involving damage to attended vehicle or property, driving without a license, driving under suspension, operating vehicle without required financial responsibility and failing to stop and give information; right to preliminary hearing waived, charges bound over for court.

Eric A. Mitchell, 20, of 1564 Stag Drive, Lake Wynonah, Auburn - driving under the influence, stop sign violation and careless driving; right to preliminary hearing waived, charges bound over for court.

Robert W. Pruitt, 32, of 616 W. Norwegian St., Pottsville; theft - right to preliminary hearing waived, charges bound over for court.
