A Shenandoah man returned to prison Tuesday after a Schuylkill County judge sentenced him for an October 2010 incident in his hometown.

John M. Najunas, 24, must spend six to 23 months in prison, Judge John E.Domalakes ruled.

Domalakes imposed the sentence after revoking Najunas' probation, which the defendant admitted violating by failing to report to his supervising officer and failing drug tests.

Najunas originally pleaded guilty on June 22, 2011, to three counts of terroristic threats and one each of simple assault and receiving stolen property. Prosecutors withdrew 22 counts of conspiracy, nine of robbery, three each of kidnapping, unlawful restraint and false imprisonment, two of theft, two additional ones of simple assault and one additional count of receiving stolen property.

At that time, Domalakes sentenced Najunas to serve 262 days to 23 months in prison with immediate parole and five additional years on probation, and pay costs and $50 to the Criminal Justice Enhancement Account, amounts the defendant still must pay under the terms of Tuesday's sentence.

Shenandoah police charged Najunas with committing his crimes on Oct. 3, 2010, in the borough.

Also on Tuesday, Domalakes sentenced Russell C. Teter, 38, of Minersville, to serve six to 12 months in prison after revoking his probation.

Teter admitted violating his probation by not reporting to his supervising officer, committing new crimes, possessing firearms and drugs, and failing a drug test.

He originally pleaded guilty on Nov. 13, 2013, to disorderly conduct. At that time, Domalakes sentenced Teter to spend 12 months on probation and pay costs, which he still must pay under the terms of Tuesday's sentence.

Minersville police had charged Teter with being disorderly on Dec. 29, 2012, in the borough.

In county court Wednesday, Judge James P. Goodman ordered Justin E. McArdle, 27, of Tamaqua, recommitted to prison for a minimum of 30 days after revoking his parole in two DUI cases.

McArdle admitted violating his parole by failing drug tests and having new criminal charges filed against him.

"He's in need of treatment," Andrew B. Zelonis, Barnesville, McArdle's lawyer, said of his client.

Goodman ordered McArdle sent to prison for at least 30 days, and barred him from being paroled for three months except to an inpatient rehabilitation facility. McArdle could remain in prison until Jan. 22, 2015, Goodman said.

McArdle originally pleaded guilty on Aug. 14, 2013, to two DUI charges. At that time, Goodman sentenced him to serve six days to 12 months in prison and pay costs, $2,000 in fines, $200 to the Substance Abuse Education Fund and $120 restitution to Schuylkill Medical Center-South Jackson Street.

Coaldale police alleged McArdle was DUI on Aug. 26, 2012, in one case, while Tamaqua police alleged he was DUI on Nov. 25, 2012, in the other.

Also on Wednesday, Goodman revoked the parole of Tyreek S. Brown, 22, of Pottsville, and ordered him returned to prison for at least three months without a chance of reparole.

Brown admitted violating his parole by failing to report to his supervising officer and failing drug tests.

"Do you have a problem with drugs and alcohol?" Goodman asked Brown, who could remain behind bars until June 19, 2015, under the terms of the judge's order.

"Marijuana," Brown answered.

Brown, who also must undergo a drug and alcohol evaluation, originally pleaded guilty on March 20, 2013, to two counts each of possession with intent to deliver a controlled substance and possession of a controlled substance. At that time, Goodman sentenced him to spend nine to 23 months in prison and pay costs, a $100 SAEF payment, $50 to the CJEA and $176 restitution to the state police crime laboratory in Bethlehem.

Pottsville police charged Brown with possessing the drugs on June 13, 2012, in the city.

In other recent county court action, Judge Cyrus Palmer Dolbin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Daniel M. Adams Sr., 43, of Klingerstown; reckless driving and failure to drive at a safe speed; $50 in fines and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of driving under the influence.

Jesse Becker, 27, of Tamaqua; conspiracy and theft by deception; 12 months probation consecutive to Luzerne County sentence, $50 CJEA payment and $188 restitution. Prosecutors withdrew charges of receiving stolen property and driving under suspension.

Charles S. Brilla, 21, of Pottsville; DUI and recklessly endangering another person; 48 hours to six months in prison, 12 months probation, $500 fine, $100 payment to the SAEF, $50 CJEA payment, $60 restitution to Schuylkill Medical Center-South Jackson Street, mental health evaluation and 30 hours community service. Prosecutors withdrew charges of reckless driving, failure to drive at a safe speed, unlawful operation, unlawful operation on streets and highways and purchase, consumption, possession or transportation of an alcoholic beverage.

Theresa E. Davidson, 41, of Shenandoah; disorderly conduct; $300 fine. Prosecutors withdrew a charge of possession of drug paraphernalia.

John O. David, 39, of Schuylkill Haven; fraudulent use or removal of registration plate; $300 fine and $50 bench warrant fee. Prosecutors withdrew charges of improper possession, sale, use or display of documents and permitting violation of title.

Dean L. Dubois, 39, of Tremont; simple assault and criminal mischief; 11 1/2 to 23 months in prison, $50 fine, $50 CJEA payment and $189.74 restitution, with sentence effective at 9 a.m. June 8. Prosecutors withdrew charges of retaliation against witness or victim, intimidation of witness or victim and harassment.

William A. Heurer Jr., 51, of Sassamansville; criminal mischief; 12 months probation, $50 CJEA payment and $3,461 restitution. Prosecutors withdrew charges of theft of services and diversion of services.

Brian M. Maberry, 24, of Schuylkill Haven; possession of drug paraphernalia and possession of a controlled substance; 23 months probation, $100 SAEF payment, $50 CJEA payment and $113 restitution to the state police crime laboratory in Bethlehem. Prosecutors withdrew charges of delivery of a controlled substance and possession with intent to deliver a controlled substance.

Michael E. Sleva, 32, of Saint Clair; two counts of possession of a controlled substance and one each of possession of a small amount of marijuana and possession of drug paraphernalia; presentence investigation ordered, sentencing scheduled for 2 p.m. June 10. Prosecutors withdrew charges of conspiracy and criminal use of a communication facility.

David A. Witherson, 34, of Jonestown; theft; 12 months probation, $50 CJEA payment and $826.71 restitution. Prosecutors withdrew a charge of receiving stolen property.

All defendants who were sentenced must pay costs as a part of their sentences.
