Pair charged in Subway burglary appear in district court

A man and woman charged with burglarizing the Subway Restaurant in Pottsville earlier this year were scheduled to appear for preliminary hearings Monday before Magisterial District Judge James K. Reiley.

However, the hearing for Morgan Scheifley, 21, of Pottsville, was continued because her attorney, Allan L. Sodomsky, Reading, was unable to attend.

Pottsville police Detective Kirk Becker charged Scheifley with one felony offense each of burglary and criminal trespass, two felony charges of conspiracy, one misdemeanor count each of theft and receiving stolen property and two misdemeanor counts of conspiracy.

Meanwhile, the woman's boyfriend, Jason W. Miller, 34, of New Philadelphia, charged with identical offenses, waived his right to a preliminary hearing and will now have to answer to all eight charges in Schuylkill County Court.

Becker said the crime occurred during the evening of March 31 or April 1 at the restaurant at 314 N. Centre St.

The detective said the investigation revealed Miller forced open the rear basement door of the business, and while he rummaged through items in the basement, Scheifley went upstairs to the dining area.

Police said that Scheifley had been an employee and, therefore, was able to gain access to the safe and remove a lock box that contained cash and rolled change.

Police said on May 29, Miller was taken from the Schuylkill County Prison where he was incarcerated on an unrelated matter, arraigned by Reiley for the burglary and recommitted to jail where he remains.

Scheifley was picked up and arraigned by on-call Magisterial District Judge David A. Plachko, Port Carbon, and initially committed to the county prison in lieu of 10 percent of $25,000 bail. The woman has since posted bail and remains free pending further court action.

Police Chief Richard F. Wojciechowsky said the burglary was reported at 6:30 a.m. April 1 and had been an ongoing investigation until all the suspected parties were arrested and incarcerated.
