A Minersville man is headed back to state prison after being sentenced Monday in Schuylkill County Court.

Matthew J. Lazovi, 25, must serve six months to five years in a state correctional institution, Judge John E. Domalakes ruled.

Domalakes imposed the sentence after revoking Lazovi's probation, which the defendant admitted violating by smoking marijuana and trying to substitute water for urine in order to pass a drug test.

The judge accepted the sentencing recommendation of Assistant District Attorney Jennifer N. Lehman and rejected Lazovi's request to be sent to the county prison.

"I did a two-year program" for sex offenders at SCI/Rockview in Centre County, Lazovi said. "I'm just trying my best to get into ... a rehab (center)."

Lazovi originally pleaded guilty on May 21, 2009, to three counts of indecent assault and two each of statutory sexual assault and corruption of minors, with prosecutors withdrawing two counts each of involuntary deviate sexual intercourse and aggravated indecent assault.

On Aug. 26, 2009, Domalakes sentenced Lazovi to serve two to four years in a state correctional institution, plus five additional years on probation, pay costs and $50 to the Criminal Justice Enhancement Account, undergo a sex offenders evaluation, have no contact with his victims, provide a DNA sample to law enforcement authorities and submit to Megan's Law sanctions for 10 years after his release from prison.

Minersville police charged Lazovi with assaulting two girls, ages 12 and 14, on June 1, 2006, in the borough.

Also on Monday, Domalakes revoked the probation of Charles A. Weidenhammer, 33, of Kutztown, and sentenced him to serve three to 18 months in prison.

Weidenhammer, who admitted violating his probation by being arrested for another crime, originally pleaded guilty on Nov. 13, 2013, to accident involving death or personal injury, accident involving damage to attended vehicle or property, driving under suspension and operating vehicle without required financial responsibility, with prosecutors withdrawing a second count of accident involving death or personal injury, and charges of failure to stop and give information and vehicle registration suspended.

At that time, Domalakes placed Weidenhammer on probation for 12 months and also sentenced him to pay costs, $800 in fines and a $50 CJEA payment, all of which the defendant still must pay under the terms of Monday's sentence.

Pottsville police had charged Weidenhammer with committing his crimes on Aug. 5, 2012, in the city.

In other county court action, prosecutors on Friday withdrew charges against three people.

Heidi Ann Hruniuk, 31, of Gilberton, had been charged with terroristic threats and harassment. Mahanoy City police alleged she committed those crimes on July 13, 2013, in the borough.

Michael J. Kachmar, 56, of Pottsville, had been charged with unlawful driving or operating of recreational or other vehicle, reckless driving an damaging real property by operation of motor vehicle. Reading, Blue Mountain & Northern Railroad police had charged Kachmar with committing those crimes on March 12 in Reilly Township.

Kyle C. Kaminsky, 37, of Gilberton, had been charged with harassment. Mahanoy City police alleged he committed that crime on July 13, 2013, in the borough.

In each case, President Judge William E. Baldwin issued an order allowing prosecutors to drop the charges and directing the defendant to pay the costs of the case.
