A Mahanoy City man drove under the influence in August 2013 in Shenandoah, a Schuylkill County judge decided Wednesday.
William J. Mooney, 43, is guilty of DUI, failure to stop at a red signal and violation of restrictions on alcoholic beverages, Judge Cyrus Palmer Dolbin ruled after a 45-minute nonjury trial.
Dolbin ordered preparation of a presentence investigation but did not immediately schedule Mooney's sentencing.
Shenandoah police charged Mooney was DUI shortly after midnight Aug. 12, 2013, when he ran a red light at Centre and Main streets, the borough's major intersection.
"I could immediately smell a strong odor of an alcoholic beverage," when he approached Mooney after the stop, Patrolman Joshua J. Pastucka testified. "His speech was slurred. He had bloodshot, watery eyes."
Mooney did not perform field sobriety tests successfully and refused to take a blood-alcohol test when asked to do so at Schuylkill Medical Center-South Jackson Street, Pastucka said.
Pastucka also said there was a bottle of beer in the car and a puddle of beer on the floor of the driver's side.
Patrolman Tyler Dissinger corroborated Pastucka's testimony.
Mooney testified he did not run the red light and denied he had been drinking.
Also on Wednesday, Kathy A. Hosler, 49, of Pottsville, must pay costs and a $100 fine after Judge Jacqueline L. Russell found her guilty of harassing two Schuylkill County Prison employees.
Pottsville police charged Hosler with yelling at her niece, Jamie Cruss, and Brian Rice about noon Feb. 16 along Sanderson Street outside the prison in the city.
"She was walking up the street. She started yelling vulgar stuff to me," Cruss testified. "Every time she sees me, she yells stuff."
"Did you do anything to entice her?" First Assistant District Attorney Maria T. Casey asked Cruss.
"I never respond to her," Cruss answered.
Rice also testified Hosler yelled profanity and that in was unprovoked.
"Neither one of us did anything to her," he said.
Hosler testified she never yelled anything to either Cruss or Rice, and the latter was not even present. However, Russell ruled against her.
"I find the commonwealth's witnesses credible," Russell said.
Magisterial District Judge James K. Reiley originally found Hosler guilty on June 3; however, the defendant appealed that ruling on June 4.
Also in county court, Dolbin on Wednesday accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Leslie A. Napolitano, 27, of Tamaqua; three counts of delivery of a controlled substance; evaluation for the state intermediate punishment program.
Carmine J. Natale, 32, of Cressona; theft; time served to 12 months in prison with immediate parole, $50 payment to the Criminal Justice Enhancement Account and $35 restitution. Prosecutors withdrew a charge of receiving stolen property.
Aaron J. Nichols, 23, of Wapwallopen; retail theft; 23 months probation and $50 CJEA payment.
April L. Reed, 39, of Klingerstown; driving under the influence; six months probation, $300 fine, $100 payment to the Substance Abuse Education Fund, $60 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service. Prosecutors withdrew a charge of disregarding traffic lane.
Alexia A. Rodriguez, 24, of Pottsville; simple assault; 23 months probation and $50 CJEA payment.
Jenny Ann Rose, 40, of Pottsville; DUI; six months probation, $300 fine, $100 SAEF payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service. Prosecutors withdrew a charge of disregarding traffic lane.
Ferdinand Savani, 25, of Berwick; DUI 48 hours to six months in prison, $500 fine, $100 SAEF payment, $60 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service. Prosecutors withdrew a charge of improper turning movements.
Michael M. Sedlock, 27, of Tamaqua; DUI and driving under suspension; 72 hours to six months in prison, $1,200 in fines, $100 SAEF payment, $460 restitution to Schuylkill Medical Center-South Jackson Street and 10 hours community service, with sentence effective at 10 a.m. July 15. Prosecutors withdrew a charge of no rear lights.
Ashley M. Sist, 28, of McAdoo; theft; 12 months probation, $50 CJEA payment and $250 restitution. Prosecutors withdrew charges of receiving stolen property and disorderly conduct.
Shane M. Stapleton, 37, of Perkasie; driving under suspension-DUI related; six to 12 months in prison and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of speeding.
Kristin V. Strunk, 47, of Pottsville; DUI, public drunkenness and disorderly conduct; 30 days in prison, 90 days house arrest with electronic monitoring, 30 days alcohol monitoring, seven months strict supervision, four years probation, $1,700 in fines, $100 SAEF payment and 10 hours community service, with sentence effective at 9 a.m. June 30. Prosecutors withdrew charges of accident involving damage to unattended vehicle or property and careless driving.
All defendants who were sentenced must pay costs as a part of their sentences.
