A Shenandoah man will not have to spend more time in prison after being sentenced Friday in Schuylkill County Court on two drug-related charges.
Instead, Zachary T. Cyr, 21, was sentenced to time served to six months in prison by Judge James P. Goodman.
Goodman also sentenced Cyr to pay costs, $100 to the Substance Abuse Education Fund, $50 to the Criminal Justice Enhancement Account and $239 restitution to the state police crime laboratory in Bethlehem.
After a one-day trial over which Judge Charles M. Miller presided, a jury found Cyr guilty on June 5 of possession of drug paraphernalia but not guilty of two counts of possession of a controlled substance. Miller found Cyr guilty of possession of a small amount of marijuana.
Shenandoah police had charged Cyr with possessing marijuana and paraphernalia on Oct. 5, 2012, in the borough.
In other recent county court action, Goodman accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:
Jason W. Miller, 34, of Pottsville - two counts of theft and one of prohibited possession of firearm; 3 1/2 to 10 years in a state correctional institution, $150 in CJEA payments, $50 bench warrant fee, $503.45 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two counts of receiving stolen property and one each of driving unregistered vehicle, driving without a license, operating vehicle without required financial responsibility, seat belt violation and operating vehicle without valid inspection.
Raymond B. Miller Jr., 44, of Ringtown - terroristic threats and criminal mischief; 12 months probation, $100 fine, $50 CJEA payment and $231.65 restitution. Prosecutors withdrew charges of agricultural trespass, travel on cultivated land, improper operation on streets and highways, operating snowmobile or ATV without required liability insurance and unlawful operation without registration certificate.
Teddy A. Fishburn, 21, of Ashland - two counts of theft and one each of criminal mischief, terroristic threats, disorderly conduct and resisting arrest; 12 months probation, $25 fine and $200 in payments to the CJEA. Prosecutors withdrew four additional counts of disorderly conduct, one additional count of theft and one count each of defiant trespass, public drunkenness, criminal trespass, receiving stolen property and simple assault.
Eric J. Garrity, 33, of Tamaqua - three counts of retail theft; six to 12 months in prison, 24 months consecutive probation, $150 in CJEA payments, $704.86 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two counts each of conspiracy and receiving stolen property and one of theft by deception.
Nicholas R. Harman, 22, of Williamstown - four counts of theft and one each of robbery, terroristic threats, receiving stolen property, simple assault and conspiracy; 15 to 36 months in a state correctional institution, $150 in CJEA payments, $1,375 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew three additional counts of receiving stolen property and one count each of harassment and criminal mischief.
Bradley M. Keppley, 25, of Pine Grove - simple assault, driving under the influence, driving without a license, failure to drive at a safe speed, careless driving, fleeing or eluding police, driving under suspension, stop sign violation and reckless driving; one to five years in prison, 12 months consecutive probation, $3,000 in fines, $100 payment to the SAEF, $100 in CJEA payments and $658.53 restitution. Prosecutors withdrew charges of harassment, criminal trespass, unauthorized use of a motor vehicle, driving under suspension-DUI related, disregarding traffic lanes and failure to notify police of accident and one additional count each of stop sign violation and careless driving.
Jason Pesavage, 35, of Shenandoah - two counts each of delivery of a controlled substance and possession of drug paraphernalia; three to 23 months in prison, $100 SAEF payment, $50 bench warrant fee, $2239 restitution to the state police crime laboratory in Bethlehem and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two counts each of possession with intent to deliver a controlled substance and possession of a controlled substance.
Janice L. Ramos, 23, of Minersville - retail theft; 12 months probation, $50 CJEA payment and $99.57 restitution.
All defendants who were sentenced must pay costs as a part of their sentences.
