Alleged drunk driver gives Shenandoah police a hard time during arrest

SHENANDOAH - Borough police jailed a Frackville man Friday, charging him with assaulting two officers.

Police said Brian Buchanan, 29, of 223 S. Second St., was arraigned on charges of two counts of aggravated assault on police, two counts of simple assault and one count each of resisting arrest, DUI and one-way roadway violations.

Police said Patrolman John Buchinsky pulled over a vehicle driven by Buchanan after seeing him go down a one-way street the wrong way about 7 p.m. Friday. Buchanan pulled over in the 100 block of East Centre Street, where he showed signs of being under the influence of alcohol.

After failing field sobriety tests, Buchinsky said Buchanan was arrested for DUI and handcuffed. Buchinsky said Buchanan said he would not submit to a blood alcohol test and refused to sign the Implied Consent form.

Buchanan tried to flee as he was being placed in the police cruiser, Buchinsky said, and gave officers trouble once he had been partly inside, sitting with his legs dangling out. Buchinsky said Buchanan kicked him in the right arm, and when the officer tried to place him inside, Buchanan kicked him again and then spat on the right side of his face and shoulder.

Buchinsky said he then opened the opposite door and tried to drag Buchanan inside. As he closed the door Buchanan repeatedly kicked the door and then sat up, slipped his hands from behind his back to the front and punched and hit the cage of the vehicle with his head.

Buchinsky said Buchanan continued to kick both doors of the vehicle and the protective cage, breaking the right door. Buchanan used Mace to bring the prisoner under control.

At the police station, Buchanan was put in a holding cell and processed with the help of Patrolman Michael O'Neill, Buchinsky said.

When asked to remove his belt, Buchanan refused and struck O'Neill on the right side of his jaw, the officer said.

Buchanan was committed to Schuylkill County Prison unable to post $50,000 straight cash bail set by Magisterial District Judge Anthony J. Kilker, Shenandoah.
