ATV accident case headed to court

TREMONT - A Ringtown woman is headed to Schuylkill County Court on charges stemming from an all-terrain vehicle accident in September 2012 in Union Township that injured another woman.

Sheri M. Dudash, 37, of 607 Aristes Road, waived her right to a preliminary hearing Thursday on charges of driving under the influence, reckless driving, unlawful operation on streets and highways and careless driving.

Magisterial District Judge Carol A. Pankake bound over those charges for court after Dudash waived her right to a hearing.

Prosecutors withdrew a charge of accident involving death or personal injury. Assistant District Attorney Michael A. O'Pake said the alleged victim consented to the withdrawal of that charge.

Dudash, who is represented by Jeffrey M. Markosky, Mahanoy City, said little Thursday in court except to indicate that she understood her waiver and the consequences of it.

Union Township police alleged that Dudash was DUI at 8:10 p.m. Sept. 8, 2012, on an ATV at 195 Ridge Road north of Ringtown in the township.

Police said Tracey L. Aponick was injured in the accident.

Pankake heard the case because Magisterial District Judge Christina E. Hale, Frackville, in whose district Union Township is located, recused herself from the case. O'Pake said he was not certain why Hale recused herself.
