A Shenandoah man is headed to state prison after being sentenced Friday in Schuylkill County Court.

Charles E. Wishnefsky, 22, must serve one to two years in a state correctional institution, Judge Jacqueline L. Russell ruled.

Russell imposed her sentence after revoking Wishnefsky's probation and parole.

Wishnefsky originally pleaded guilty on Nov. 14, 2012, to possession with intent to deliver a controlled substance, risking a catastrophe, prohibited possession of an offensive weapon, possession of a controlled substance and possession of drug paraphernalia.

At that time, Russell sentenced him to serve 80 days to 23 months in prison with immediate parole, pay costs, $100 to the Substance Abuse Education Fund, $50 to the Criminal Justice Enhancement Account, a $50 bench warrant fee and $176 restitution to the state police crime laboratory in Bethlehem, and submit a DNA sample to law enforcement authorities.

Shenandoah police had charged Wishnefsky with committing his crimes on Aug. 10, 2011, in the borough.

Also on Friday, Russell revoked the probation of Christine Maurer, 52, of Pottsville, and sentenced her to serve four to 12 months in prison.

Maurer originally pleaded guilty on April 24 to theft, with prosecutors withdrawing charges of access device fraud and receiving stolen property. At that time, Russell sentenced her to spend 12 months on probation and pay costs and a $50 CJEA payment.

Schuylkill Haven borough police charged Maurer with committing the theft on Sept. 29, 2012, in the borough.

In another Friday case, Judge James P. Goodman found Dale L. Rittenbaugh, 68, of Pine Grove, not guilty of defiant trespass.

State police at Schuylkill Haven had charged Rittenbaugh with trespassing on May 29. Senior Magisterial District Judge Bruce F. Appleton, Tremont, had found Rittenbaugh guilty on Aug. 19, but the defendant appealed that ruling on Sept. 3.

In other recent county court action, Russell accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Matthew J. Dewald, 26, of Pottsville; two counts each of possession of a controlled substance and possession of drug paraphernalia and one of improper furnishing of drug-free urine; eight days to 12 months in prison with immediate parole, 24 months consecutive probation, $200 in payments to the SAEF, $150 in payments to the CJEA and 100 hours community service. Prosecutors withdrew two counts each of delivery of a controlled substance and possession with intent to deliver a controlled substance.

Michael M. Hill, 57, of Pottsville; public drunkenness; 78 days in prison with immediate parole and 20 hours community service. Prosecutors withdrew a charge of criminal trespass.

Joseph W. Kane, 41, of Pottsville; theft by deception and conspiracy; one to 12 months in prison, $50 CJEA payment, $6,663.50 restitution, 40 hours community service and submission of a DNA sample to law enforcement authorities, with sentence effective at 1 p.m. Jan. 4, 2014. Prosecutors withdrew a charge of receiving stolen property.

Benjamin P. Kline, 27, of Pottsville; possession of a small amount of marijuana; 30 days probation, $100 SAEF payment, $50 CJEA payment and 20 hours community service. Prosecutors withdrew a charge of public drunkenness.

Laurie A. Lauer, 51, of Allentown; theft; 12 months probation, $50 CJEA payment and 20 hours community service. Prosecutors withdrew a charge of receiving stolen property.

All defendants who were sentenced must pay costs as a part of their sentences.
