A preliminary hearing scheduled for Friday for a Philadelphia man charged with a robbery in Pottsville was continued.

Dustin Ballard, 24, of 110 Tulpehocken St., was picked up with his brother, Anthony M. Ballard, and Jaimee Jacinta Watson after a shooting in Pottsville on June 11 on an outstanding warrant for an armed robbery in the city April 4.

Pottsville police charged him with robbery, burglary and aggravated assault, all felony offenses, as well as misdemeanor charges of theft by unlawful taking, receiving stolen property, firearms not to be carried without a license and simple assault.

Dustin Ballard is not charged in connection with the June 11 shooting.

Anthony Ballard and Watson were committed to Schuylkill County Prison without bail while Dustin Ballard was committed to prison in lieu of $100,000 straight cash bail. All three remain incarcerated.

Pottsville police Cpl. Francis Lynagh charged Dustin Ballard with the robbery at 309 W. Norwegian St. about 9:05 a.m., where he and Anthony Ballard allegedly forced their way into an apartment and each brandished a handgun while threatening Jonathan Porter and Nicole Porter.

While in the apartment, Lynagh said Dustin Ballard pointed a gun at Jonathan Porter's head and stole a wallet from his pants pocket. Porter said the wallet contained more than $300 in cash and his identification and bank cards, the corporal said.

Pottsville police Capt. Richard Wojciechowsky said both brothers were charged with the crime and warrants were issued for their arrests.

Anthony Ballard had a preliminary hearing but the charges against him were dismissed when Nicole Porter changed her story about the events that occurred, the captain said.
