An Ashland woman is headed to state prison after being sentenced Wednesday in Schuylkill County Court on a charge of receiving stolen property.
Brandi Benjamin, 23, must spend nine to 24 months in a state correctional institution, Judge John E. Domalakes ruled.
Both Assistant Public Defender Kent D. Watkins, Benjamin's lawyer, and Assistant District Attorney Jennifer N. Lehman agreed to the imposition of the sentence.
Benjamin originally pleaded guilty on May 22, 2013, to receiving stolen property, with prosecutors withdrawing a charge of conspiracy. At that time, Domalakes placed Benjamin on probation for 23 months and also sentenced her to pay costs and $50 to the Criminal Justice Enhancement Account, amounts she still must pay under the terms of Wednesday's sentence.
However, Domalakes revoked Benjamin's probation on Jan. 22.
State police at Frackville had charged Benjamin with possessing the stolen property on May 15, 2012, in West Mahanoy Township.
Also on Wednesday, Senior Judge D. Michael Stine found Michael S. Ebling, 29, of Pottsville, not guilty of indirect criminal contempt, which is contempt committed outside the courtroom.
New Philadelphia police had charged Ebling with committing the contempt by violating a protection from abuse order on Feb. 9, 2012, in the borough.
In two other cases Wednesday, two men were convicted in Schuylkill County Court of violating protection from abuse orders in March.
Kyle R. Klinger, 28, of Schuylkill Haven, is guilty of indirect criminal contempt, which is contempt committed outside the courtroom, Senior Judge D. Michael Stine ruled. Stine sentenced Klinger to spend 20 days in prison and pay costs and a $300 fine.
Saint Clair police had charged Klinger with violating the order against him on March 12 in the borough.
Stine also found Dennis J. Powanda, 31, of Pottsville, guilty of indirect criminal contempt. The judge sentenced Powanda to pay costs and a $300 fine.
Port Carbon police had charged Powanda with violating the order against him on March 5 in the borough.
Schuylkill County prosecutors withdrew criminal charges against three defendants.
Richard A. Harner, 27, of Pottsville, had been charged with access device fraud. State police at Schuylkill Haven had alleged he committed that crime on April 21, 2012.
Arthur J. Johns, 56, of Pottsville, had been charged with retaliation against witness or victim, disorderly conduct and harassment. Pottsville police alleged he committed those crimes on May 12, 2013, in the city.
Luke E. Miller, 19, of Cressona, had been charged with receiving stolen property. Pottsville police alleged he committed that crime on June 26, 2013, in the city.
In each case, President Judge William E. Baldwin signed an order Thursday allowing prosecutors to withdraw the charges and directing the defendant to pay the costs of the case.
A Pine Grove woman must pay costs and a fine after being found guilty Thursday in Schuylkill County Court of harassing someone.
Sandy L. Phillippy, 51, is guilty of harassment, Judge Charles M. Miller ruled.
Miller, who heard the case without a jury, sentenced Phillippy to pay costs and a $25 fine.
Pine Grove police had charged Phillippy with committing the harassment on Dec. 5, 2013, in the borough. Magisterial District Judge James R. Ferrier, Orwigsburg, found Phillippy guilty on Jan. 29, but the defendant appealed that ruling on Feb. 28.
