A Frackville man was acquitted Thursday in Schuylkill County Court when prosecutors could not present a case against him.

Todd J. Swantek, 46, had been charged with harassment. However, Judge James P. Goodman found him not guilty when neither the prosecuting officer nor any other witnesses appeared to testify against him.

Frackville borough police had charged him with committing harassment on Feb. 9 in the borough. Magisterial District Judge Christina E. Hale, Frackville, had found Swantek guilty on Feb. 27, but he appealed that ruling on March 26.

Also on Thursday, Goodman found Krystal J. Flickinger, 23, of Locustdale, not guilty of giving false information when prosecution witnesses did not show up to testify.

State police at Frackville, who did appear for the hearing, had charged Flickinger with giving the false information on Dec. 17, 2013. Hale had found Flickinger guilty on Feb. 18, but the defendant appealed that decision on March 18.

In other recent county court action, Goodman accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Brian G. Conville, 37, of Pottsville - false alarm; 12 months probation and $50 payment to the Criminal Justice Enhancement Account.

Virginia Crawford, 39, of Tremont - corruption of minors and retail theft; 18 months probation, $150 fine, $50 CJEA payment and $79.99 restitution.

Mary K. Darzinikas, 59, of Schuylkill Haven - driving under the influence and disregarding traffic lane; 90 days to five years in prison, $1,525 in fines, $100 payment to the Substance Abuse Education Fund and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of careless driving.

In other court action Thursday, a York County man went to prison after a Schuylkill County judge revoked his probation stemming from an incident in November 2012 in Pottsville.

Raymond C. Acker Jr., 20, of Dallastown, must serve four to 23 months in prison, Judge John E. Domalakes ruled.

Acker, who admitted violating his probation, initially pleaded guilty on Sept. 25, 2013, to two counts of corruption of minors, with prosecutors withdrawing a charge of purchase, consumption, possession or transportation of an intoxicating beverage.

At that time, Domalakes placed Acker on probation for 23 months, and also sentenced him to pay costs and $50 to the Criminal Justice Enhancement Account, amounts the defendant still must pay under the terms of Thursday's sentence, and perform 10 hours community service.

Pottsville police charged Acker with committing his crimes on Nov. 3, 2012, in the city.

In other recent county court action, Judge James P. Goodman accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Nathaniel Davis Jr., 64, of Tamaqua - driving under the influence; 48 hours to six months in prison, $500 fine, $100 payment to the Substance Abuse Education Fund and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of failure to drive at a safe speed.

Derek S. Dymek, 26, of Fountain Hill - DUI and possession of drug paraphernalia; six months in the intermediate punishment program, 12 months consecutive probation, $1,000 fine, $100 SAEF payment and $60 restitution to Schuylkill Medical Center-South Jackson Street.

Jerry A. Vanderpool Jr., 29, of Pottsville - harassment; $100 fine. Prosecutors withdrew a charge of simple assault.

Lewis E. Yeich, 46, of Saint Clair - criminal trespass; $150 fine.

All defendants who were sentenced must pay costs as a part of their sentences.
