Anthony R. Ades showed up sober Wednesday in Schuylkill County Court, unlike the last time he was there, but it did not save him from a trip to state prison for crimes stemming from an altercation with West Penn Township police.
Ades, 56, of Tamaqua, must serve 15 to 48 months in a state correctional institution, Judge Cyrus Palmer Dolbin ruled.
Under the terms of the plea agreement between prosecutors and Ades, Dolbin also sentenced the defendant to pay costs, a $1,000 fine, $300 to the Substance Abuse Education Fund, $50 to the Criminal Justice Enhancement Account, $460 restitution to Schuylkill Medical Center-South Jackson Street and $72.90 restitution to West Penn Township. Dolbin made the sentence effective at 9 a.m. Aug. 5, and allowed Ades to remain free on $25,000 straight cash bail until then.
Ades pleaded guilty to two counts of recklessly endangering another person and one each of terroristic threats, institutional vandalism and driving under the influence. Prosecutors withdrew two counts of aggravated assault and one of speeding.
West Penn Township police alleged Ades was DUI at 11:15 a.m. July 11, 2012, on West Penn Pike (Route 309) in South Tamaqua.
Police said Ades tried to ram their car with his 1999 Pontiac Grand Am, damaged it and then threatened to blow an officer's head off.
Police also said Ades had a blood alcohol level of 0.166 percent; the legal limit for driving in Pennsylvania is 0.08 percent.
During Wednesday's hearing, Ades said little except to tell Dolbin that he understood the terms of his guilty plea and that he was making it knowingly and voluntarily.
He originally had been scheduled to enter his guilty plea on May 22 before Judge John E. Domalakes.
However, Ades was intoxicated that day to such an extent that he passed out in the courtroom, and Domalakes refused to accept his plea, instead revoking his bail and ordering him sent to prison. Ades later had his bail reinstated and was able to post it in June.Defendant: Anthony R. Ades
