Although he admitted Wednesday in Schuylkill County Court to crimes stemming from three separate incidents, Michael A. Killian might not have to spend more time in prison, provided he remains on the right side of the law for almost four years.
Killian, 23, of Schuylkill Haven, pleaded guilty to aggravated assault, disorderly conduct, driving under the influence, stop sign violation and theft. Prosecutors withdrew charges of simple assault, seat belt violation and receiving stolen property.
Judge Cyrus Palmer Dolbin accepted Killian's plea, and, pursuant to the agreement between prosecutors and the defendant, sentenced him to serve five to 23 months in prison with immediate parole plus 23 additional months on probation, pay costs, $525 in fines, $100 to the Substance Abuse Education Fund, $100 to the Criminal Justice Enhancement Account and $602.31 restitution, and submit a DNA sample to law enforcement authorities.
In his plea, Killian admitted committing crimes in three separate incidents, all of which occurred in October 2012.
In the first, state police at Schuylkill Haven charged him with stealing 25 beer barrels from the Beer Shack, Schuylkill Haven, on Oct. 4.
Pottsville police charged him in the second incident with assaulting state police Trooper Eric Reber on Oct. 14 in the city.
Finally, state police at Schuylkill Haven alleged he was DUI on Oct. 14.
Killian said little during Wednesday's hearing except to indicate he understood the terms of his plea and that it was voluntary and intelligent.
