Criminal court, June 16, 2013

In recent Schuylkill County Court action, Judge John E. Domalakes accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Brandi N. Benjamin, 22, of Shenandoah; receiving stolen property; 23 months probation and $50 payment to the Criminal Justice Enhancement Account. Prosecutors withdrew a charge of conspiracy.

Tyrone E. Bruton, 45, of Pottsville; harassment; $300 fine. Prosecutors withdrew charges of theft and receiving stolen property.

Jesse P. Dembinsky, 27, of Saint Clair; driving under the influence and simple assault; 72 hours to six months in prison, 18 months consecutive probation, $1,000 fine, $300 payment to the Substance Abuse Education Fund and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew a charge of aggravated assault.

Edward F. Doran, 50, of Branchdale; DUI, failure to drive at a safe speed and failure to stop at red signal; five years in the intermediate punishment program, $1,550 in fines and $100 SAEF payment. Prosecutors withdrew charges of careless driving and failure to keep right.

Troy B. Fisher, 35, of Pottsville; accident involving death or personal injury, failure to notify police of accident and seat belt violation; two years probation and $35 in fines. Prosecutors withdrew charges of accident involving damage to attended vehicle or property, vehicle improperly turning left, careless driving and failure to stop and give information or render aid.

Jennifer Gates, 36, of Shenandoah; two counts of simple assault and one of possession of drug paraphernalia; 23 months probation, $50 CJEA payment and $50 bench warrant fee. Prosecutors withdrew two counts of harassment and one each of criminal trespass, disorderly conduct and public drunkenness.

Joshua S. Generella, 24, of Tuscarora; burglary; six to 23 months in prison, $50 CJEA payment, $50 bench warrant fee, $1,162.27 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew two counts each of criminal trespass, theft and receiving stolen property and one each of conspiracy and criminal mischief.

Ekaterina E. Jones, 32, of Pottsville; DUI; six months in the intermediate punishment program, $1,000 fine, $100 SAEF payment and $60 restitution to Schuylkill Medical Center-South Jackson Street. Prosecutors withdrew charges of careless driving and improper driving on the left side.

Albin Kaminsky, 38, of Shenandoah; resisting arrest; 12 months probation and $50 CJEA payment. Prosecutors withdrew a charge of possession of a controlled substance.

Steven J. Mallick, 33, of Frackville; recklessly endangering another person and simple assault; 12 months probation, $50 CJEA payment and $2,461.73 restitution. Prosecutors withdrew a second count of simple assault and charges of harassment and careless driving.

A Beaver County woman was found guilty Monday in Schuylkill County Court of trying to smuggle drugs into a state correctional institution.

Jurors found Shawna Mastramico, 23, of Aliquippa, guilty of possessing contraband/controlled substance, possession with intent to deliver a controlled substance and possession of a small amount of marijuana.

President Judge William E. Baldwin, who presided over the one-day trial, ordered preparation of a presentence investigation, scheduled Mastramico's sentencing for 9 a.m. Aug. 6 and allowed her to remain free on $25,000 percentage bail.

State police at Frackville had charged Mastramico with trying to smuggle marijuana into SCI/Mahanoy on July 26, 2012.

Also on Monday, James J. Gatens, 61, of Tamaqua, pleaded guilty to failure to stop at a red signal, with prosecutors dropping a charge of driving under the influence.

Judge James P. Goodman, who had been scheduled to preside over Gatens' nonjury trial, instead accepted his plea and sentenced him to pay costs and a $25 fine.

Tamaqua police had alleged that Gatens was DUI on Sept. 30, 2011, in the borough.

In other recent county court action, Baldwin accepted guilty pleas from, and, pursuant to agreements between prosecutors and defendants, imposed the indicated sentences on, these people:

Benjamin I. Delong, 20, of Schuylkill Haven; possession of a small amount of marijuana, possession of drug paraphernalia and theft; 23 months probation, $100 payment to the Substance Abuse Education Fund and $50 payment to the Criminal Justice Enhancement Account. Prosecutors withdrew charges of purchase, consumption, possession or transportation of an intoxicating beverage, receiving stolen property, conspiracy and defiant trespass.

Thomas J. Elliott, 46, of Schuylkill Haven; no contest plea to disorderly conduct; $300 fine. Prosecutors withdrew charges of simple assault, harassment and public drunkenness. By pleading no contest, Elliott did not admit committing the crime, but offered no defense to the charge, admitted prosecutors had enough evidence to prove him guilty beyond a reasonable doubt and agreed to be sentenced as if he had pleaded or been found guilty.

William J. Kramer Jr., 31, of Williamstown; two counts of defiant trespass; $200 in fines. Prosecutors withdrew two counts each of theft and receiving stolen property.

Amanda L. Riegel, 30, of Mount Carmel; theft by deception; three days to 18 months in prison, $50 CJEA payment and $300.33 restitution.

Michael E. Ruckhardt, 31, of Nesquehoning; forgery; 23 months probation, $2,300 restitution and submission of a DNA sample to law enforcement authorities. Prosecutors withdrew charges of theft and receiving stolen property.

Regina Sefing, 46, of Pottsville; DUI and careless driving; five years in the intermediate punishment program, $1,525 in fines, $100 SAEF payment, $460 restitution to Schuylkill Medical Center-South Jackson Street and 40 hours community service.

Tracy Shide, 58, of McAdoo; two counts each of delivery of a controlled substance, possession of a controlled substance and possession of drug paraphernalia; sentencing deferred pending preparation of a presentence investigation.

Donna E. Shistel, 60, of Barnesville; DUI and endangering the welfare of children; six months in the intermediate punishment program, 12 months consecutive probation, $1,000 fine, $300 SAEF payment, $50 CJEA payment and $60 restitution to Schuylkill Medical Center-South Jackson Street.

All defendants who were sentenced must pay costs as a part of their sentences.
